By law in New Jersey ( NJ ), if you worked at a job which was covered under the provisions of the Social Security Act, paid Social Security taxes, and are now disabled, you may be entitled to Social Security Disability. The Social Security Administration, in determining eligibility for disability benefits, will, in most cases, look at how much Social Security tax has been taken in the 10 years prior to the onset of an individual’s disability. Social Security offers disability benefits in some cases to those individuals in NJ (New Jersey) that are disabled but may not have met the work requirements described above. This program is called SSI or Supplemental Security Income. SSI is a needs-based disability program for people in New Jersey and throughout the country who are physically or mentally disabled due to illness or injury. Unlike Social Security Disability, one need not have an established work history to qualify for SSI benefits, nor does one need to have paid any Social Security taxes. However, an individual must qualify financially, meaning one must have very little income or assets. Should your income and assets combined meet the limits set forth by Social Security, you would be eligible to make a claim for SSI disability benefits.
It is possible, in some cases, to be eligible for both Social Security Disability and SSI benefits. One must meet the work history requirements for Social Security Disability as described above, but the amount of the disability benefit is very low and your total income and assets fall within the limits for SSI eligibility.
