New Jersey Social Security Disability
Social Security offers disability benefits in some cases to those individuals in NJ (New Jersey) that are disabled but may not have met the work requirements described above. This program is called SSI or Supplemental Security Income. SSI is a needs-based disability program for people in New Jersey and throughout the country who are physically or mentally disabled due to illness or injury. Unlike Social Security Disability, one need not have an established work history to qualify for SSI benefits, nor does one need to have paid any Social Security taxes. However, an individual must qualify financially, meaning one must have very little income or assets. Should your income and assets combined meet the limits set forth by Social Security, you would be eligible to make a claim for SSI disability benefits.
The New Jersey Social Security Disability Application Process:
Let lawyers do the work and take the burden away from you! In New Jersey ( NJ ), anyone may file on their own for Social Security Disability benefits. However, statistics clearly show that individuals with representation by a lawyer win benefits much more often than those who apply on their own. The process to obtain either form of disability mentioned above usually consists of three steps - the initial application, reconsideration and hearing before an Administrative Law Judge. While many people with lawyer representation do win their claims at the hearing level or earlier, some get denied. If this happens, it is possible to appeal your case to the Appeals Council and Federal Court. Attorney Andrew Leibovitz can assist you in all stages of the process, including an appeal should you be denied. The government does make the process difficult by requiring complicated and lengthy forms, long wait times, and eventually the denial of some very legitimate claims. Individuals who contemplate giving up are often doing themselves a great disservice and may be giving up disability benefits that they should be entitled to getting. Andrew Leibovitz is a New Jersey disability lawyer who does not let the government intimidate his clients and will always fight aggressively to preserve the rights and entitlements of his clients.
